    On Friday, the Supreme Court ruled that corporations and people may sue the government over the Affordable Care Act, which requires all states to maintain minimum levels of medical insurance for its residents. The ruling involved two provisions of the act, as well as a separate provision of the law, the pre-existing condition rule. The ruling is a win for the corporate interests that brought the suit.

    Responsibility for the outcome rests primarily with Justice Roberts. His vote has not been announced and will probably be a close call between two possibilities. On the one hand, there is Justice Kagan’s vote — let’s call it a 6-3 win for the corporate interests. Kagan does not view the corporate interests as an ethnic minority. Presumably she sees the corporate interests as part of the United States, a United States that is as diverse as it can be. At the same time, she is more likely to view the countervailing interests of the people in the United States as an ethnic minority. As a result, she would defer to them in public interest cases and she would limit the reach of the law to those who sought it out. On this view, the case is a win for the people, but less of a win because of the fine.

    On the other hand, there is Justice Thomas’ vote — let’s call it a 6-3 win for the people. The assumption here is that Justice Thomas would view the corporate interests as an ethnic minority because of his record of supporting ethnic interests. And because they are not an ethnic minority, they are not entitled to the same deference as people. He would not allow the court to substitute its own judgment for the majority political judgment of the president and Congress. That is the kind of result that would allow the people in the United States to hold their government accountable.

    The second outcome, if Justice Thomas is the swing vote, could mean a deadlock, which might give Chief Justice Roberts
