¶ 11 Furthermore, once it was apparent that the jury was confused as to the meaning of the question, the district court’s granting of the State’s motion for a mistrial was not an abuse of discretion. A district court has broad discretion in deciding whether to declare a mistrial. State v. Rader, 2008 UT App 273, ¶ 6, 185 P.3d 38. It is not an abuse of discretion for a district court to grant a mistrial if the jury’s ability to render an impartial verdict is irreparably impaired. State v. Field, 2008 UT 81, ¶ 27, 199 P.3d 821. Here, the jurors were clearly confused by the ambiguous question. The district court’s granting of the State’s motion for mistrial, therefore, was not an abuse of discretion.
CONCLUSION
¶ 12 While a different interpretation of the question may have been the intent of the question, the question, when read and applied as intended by the district court, was not so confusing that it deprived the jury of its ability to render an impartial verdict. Rather, the instruction was given correctly to tell the jury that the question was intended to elicit a negative response. The answer to the question, no, did not lead to any further questions. In fact, the jury asked no further questions throughout its deliberation. Under these circumstances, the district court’s granting of a mistrial was not an abuse of discretion. Accordingly, we affirm the district court’s decision to grant the State’s motion for a mistrial.
