HOUSTON — Three former Houston police officers will stand trial on murder charges in connection with the shooting death of a Black man in his own front yard while he was in his underwear.
Prosecutors said the case will highlight a “culture of excessive force” in the Houston Police Department.
The officers will go on trial in September. The victim, whose identity is being withheld at his family’s request, was shot in November 2013.
The officers shot the man after they were called to the area to help a woman who had been slapped by her husband.
Lawyers for the men said the man was shot in the back while running away, and that the officers were attempting to arrest him, not shoot him.
The Associated Press is not naming the officers because they haven’t been charged with a crime.
The district attorney’s office said in a statement Tuesday that the defendants “routinely violated” department policies.
“The belief is that the culture of excessive force and the culture of criminality within the HPD permeated throughout the ranks,” said Vince Ryan, special prosecutor in the case.
Killed in the incident was Kevin Ferguson, 27, who was in his underwear when shot. The officers said Ferguson shot at them first.
A grand jury decided in December 2013 not to indict Ferguson’s two daughters, who were seated on a couch in the home, as well as the police officers who were at the scene that night.
The shooting also resulted in a police shooting of a 7-year-old boy. Police said the child and his mother, who also was in the home, shot at the officers first.
The boys’ father, Keith Cosey, was angry at the outcome of the grand jury and decided to become an activist, going to the media with his views on the case.
In the indictment, prosecutors said Ferguson’s shooting led to the death of 1-year-old Shea and her 2-year-old brother, who were in the home during the incident. Prosecutors said Ferguson fired at the officers from a door frame in the home.
