The common law doctrine of jurisdictional immunity has since long been a legal concept that is primarily concerned with the relationship between a foreign court and its own courts.

However, in its modern context, the doctrine of jurisdiction is no longer regarded as an issue of territoriality, but is a function of the general principles of international comity and international law. In general, different considerations influence the rules with regard to a foreign court’s jurisdiction over a dispute between two parties from those affecting the jurisdictional authority of a domestic court, where one of the parties is a national of the country in which the dispute is brought. There is no direct analogue of a jurisdictional immunity regime for national courts that is governed by treaty or international custom.

A basic difference lies in the fact that the general rule of international law is that subjects of a state are subject to the jurisdiction of the state’s courts and are not entitled to seek the protection of another state’s court when the dispute arises in that state’s territory. In contrast, there is no principle of domestic law that prohibits a non-national from invoking the protection of a foreign state’s courts, in terms of jurisdictional immunity.

Under the principles of international law, all state nationals are considered as being subject to the jurisdiction of the courts of every other state with which they have a treaty, if they are not in the territory of that state. However, members of international organizations are not to be considered as being subject to the jurisdiction of the courts of any state within which they are present.

Scientists, authors, journalists, engineers, artists, theologians, ethicists and others have shared their unique insights and experiences with students, who have been encouraged to take part in a lively and often spirited discussion.
History of Skeptics The Society of Skeptics was established as a forum for students and faculty to discuss and debate important global issues; it has grown to become one of the premier high school lecture series in the United States. Each week, speakers from the political, social, scientific, economic and literary arenas share their unique perspectives with students, who are encouraged to engage with presenters, asking questions and debating points of view. The program, which is funded in part by the Class of 1968 Society of Skeptics Endowment Fund, is an outgrowth of the Blair International Society, begun in 1937. Forty years later, former history department chair Elliott Trommald, PhD, Hon. 65, established the modern Skeptics program as a regular forum for student discussion and debate; history teacher Martin Miller, PhD, took over in the mid-1980s and molded the program into a weekly lecture series, one that has since continued without interruption.
